GENERAL TERMS AND CONDITIONS OF SALE (GTCS) – ClassElite.fr

1. Preamble
These General Terms and Conditions of Sale (GTCS) govern the use of the ClassElite.fr website as well as the conditions applicable to the subscription and provision of the services offered. Any registration or use of the services implies full acceptance of these GTCS by the customer (hereinafter « the Client »).
2. Company Identification
The ClassElite.fr website is operated by IKKIGAI SAS, a simplified joint-stock company registered with the Trade and Companies Register under number 917 606 824, whose registered office is located at 8 rue Juliette Lamber, 75017 Paris, France. 3. Services Offered
ClassElite.fr offers personalized educational support services, including individual face-to-face or remote tutoring, as well as training tailored to students’ needs (Bootcamp, Club Sandwich, etc.). Specific training for businesses (professional training) is also provided. Detailed terms (content, duration, pricing) are available on the website or specified during registration.
4. Client Obligations
The Client agrees to comply with the rules of punctuality, preparation, and respectful conduct towards tutors and the teaching team. Any inappropriate behavior may result in temporary or permanent exclusion from services, without refund or recourse.
5. Session Duration, Billing, and Communication with Tutors
Tutoring sessions have a minimum duration of 1 hour 30 minutes. Any extension will be rounded up to the next half-hour and billed accordingly. When a course is provided to a minor, the minor is, by default, free to communicate directly with their tutor to organize and schedule their sessions, within an educational and secure framework. If the minor’s legal guardian wishes to set limits on this communication (restriction of exchanges or supervision), they must inform the teaching team by email at hello@classelite.fr. These restrictions will be applied upon receipt and validation of the request.
6. Payment Terms
For individual courses and professional training, payment is made by bank transfer upon receipt of the monthly invoice. In case of late payment, a penalty equal to three times the legal interest rate as well as a fixed indemnity of 40 euros for recovery costs will be applied, in accordance with the Commercial Code. Any delay exceeding 2 weeks will result in the suspension of sessions until settlement. For the Bootcamp and Club Sandwich, payment is required in advance and exclusively online.
7. Cancellation Policy
Any cancellation of an individual course must be reported at least 24 hours in advance. In case of late cancellation or unjustified absence, fees equivalent to 1 hour 30 minutes of the course will be charged. For the Club Sandwich, a cancellation after payment may result in a postponement to another session (subject to availability); if it occurs less than 24 hours before the session, no postponement or refund will be possible.
8. Tutor Absence
In case of a tutor’s unavailability, ClassElite.fr will offer a replacement or postponement of the session. The tutor will directly organize the rescheduling with the student or, where applicable, their legal guardian.
9. Right of Withdrawal and Refund
In accordance with Article L. 221-18 of the Consumer Code, the Client has a withdrawal period of 14 days from the subscription date. However, no refund will be granted for sessions already completed.
10. Non-Solicitation of Tutors
Tutors collaborate exclusively with ClassElite.fr. It is strictly forbidden for the Client to solicit them outside the established contractual framework, under penalty of sanctions that may include immediate termination of services.
11. Academic Responsibility
ClassElite.fr tutors support students in their progress by providing explanations, strengthening their skills, and promoting their autonomy. No specific results (grades, admissions) can be guaranteed, as success depends on factors beyond our control.
12. Intellectual Property Protection
The educational materials provided by ClassElite.fr are protected by intellectual property law. Any reproduction, copying, or distribution without prior written authorization is prohibited.
13. Confidentiality
ClassElite.fr is committed to protecting the personal and academic data of clients, in accordance with the General Data Protection Regulation (GDPR). This information will not be shared or disclosed without the prior consent of the Client or, for minors, their legal guardian.
14. Force Majeure
ClassElite.fr cannot be held responsible for cancellations or postponements of sessions due to unforeseeable events beyond its control (strikes, natural disasters, technical failures, etc.).
15. Disputes and Applicable Law
These GTCS are subject to French law. In case of dispute, an amicable resolution will be sought in priority. Failing that, the competent courts of Paris will be seized.
16. GTCS Modifications
ClassElite.fr reserves the right to modify these GTCS at any time. The applicable conditions are those in force at the time of subscription, available on the website www.classelite.fr.
